Déjà Vu: District Court rules on State secrecy

Remanded appeal points dismissed by DC Circuit Court

On remand from the D.C. Circuit Court of Appeals, the Honorable Richard J. Leon has again held that the State Department correctly withheld a portion of an email concerning a discussion between a State Department employee and an archaeologist lobbying for the inclusion of coins in the Cypriot MOU.  The Court also held that additional searches of backup tapes for relevant emails would be excessively burdensome to the State Department.  The decision was predicated on additional information provided on remand to the District Court by a State Department employee about the confidentiality of the email and the search for other relevant emails.   The ACCG believes that the process for imposing import restrictions on cultural goods has been veiled in secrecy and calls on the State Department to honor President Obama’s promise for greater transparency.
