Decision released in Baltimore litigation

By Peter K. Tompa |
August 08, 2011

The  US District Court has held that  import restrictions on ancient coins from Cyprus and China are not subject to judicial review under the Administrative Procedure Act because the decision derived from presidential power.  The Court also held that although it could determine whether the import restrictions were contrary to governing  law, the restrictions as written were not invalid even though they did not explicitly limit their reach to coins first discovered in Cyprus and China.   ACCG is reviewing its legal options going forward.  A copy of the Court’s opinion can be found here.
